Compatible Growth Area Applications

Once you have determined that your property is within the Compatible Growth Area (CGA) and that it may require a decision from the Commission, please review this section to ascertain the type of application you may need to fill out. You can then download the appropriate application form in pdf format through the links provided below or from our online document library.

There are four types of Compatible Growth Area applications. Please read the following descriptions carefully and also go to Volume 1, Chapter 4 of the Central Pine Barrens Comprehensive Land Use Plan ("Plan") to read more about the criteria and procedures for each application. Depending on the category your project falls under it will need to conform either to the Standards for Land Use or both the Standards and Guidelines for Land Use identified in Volume 1, Chapter 5 of the Plan.

Compatible Growth Area Hardship (CGA) Application - Non-conforming Project: Development located within the Compatible Growth Area which does not conform to the standards contained in Volume 1, Chapter 5 of the Plan. Projects in this category normally go to the appropriate Town for project review first and the staff at that Town determines that the project does not meet the standards. The applicant is then advised to either revise their project or file an application with the Commission. See Section 4.5.2 of Volume 1, Chapter 4 of the Plan. Projects in this category need to meet the standards for development in Volume1, Chapter 5 of the Plan.

Compatible Growth Area Application (CGA) for Commission Petitioned Project - Development located within the Compatible Growth Area which has been subjected to a petition by the Commission pursuant to ECL Section 57-0123(2). This type of application is also commonly referred to as an "assertion of jurisdiction" or a "call up". Projects in this category are required to be reviewed by the Commission when the Commission votes that a particular project may have a significant adverse impact upon the goals of the Plan. See Section 4.5.3 of Volume 1, Chapter 4 of the Plan. Projects in this category need to meet the standards and guidelines for development identified in Volume 1, Chapter 5 of the Plan.

Compatible Growth Area (CGA) CRA Application - Development located within the Compatible Growth Area which is also located within a Critical Resource Area (CRA). Projects in this category are located in a Critical Resource Area as defined and mapped in Chapter 4 of the Plan. This application is only required if the project is within one of these designated areas. See Section 4.5.4 of Volume 1, Chapter 4 of the Plan. Projects in this category need to meet the standards and guidelines for development identified in Volume 1, Chapter 5 of the Plan.

Compatible Growth Area (CGA) Development of Regional Significance Application - Development located within the Compatible Growth Area which is a Development of Regional Significance (DRS). Projects in this category are defined in Chapter 4 and are only required to apply to the Commission if they meet the designated criteria as a DRS. See Section 4.5.5 of Volume 1, Chapter 4 of the Plan.
